Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you (“you,” “your”) and APTcache (“we,” “us,” or “APTcache”). By creating an account or otherwise using the APTcache service — the marketing site, the application, the authorization server, and any associated APIs (together, the “Service”) — you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) and able to form a legally binding contract. If you use the Service on behalf of an organisation, you confirm that you have the authority to bind that organisation, and “you” in these Terms refers to that organisation.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to:

  • Provide accurate and current information at sign-up and keep it updated
  • Use a strong password and enable multi-factor authentication where supported
  • Promptly notify us at support@aptcache.com of any unauthorised access or suspected compromise
  • Not share your credentials with anyone, including by allowing automated impersonation
  • Not create more than one personal account, or any account using false identity, unless we explicitly permit it (e.g. service accounts for machine-to-machine integrations)

3. Acceptable use

You agree not to, and not to allow any third party to:

  • Use the Service to violate any applicable law, regulation, or third-party right (including intellectual property, privacy, or publicity rights)
  • Interfere with or disrupt the integrity or performance of the Service — including by attempting to circumvent rate limits, security controls, or access boundaries
  • Attempt to access accounts, data, or systems you have no authorisation to access — see §11 (Security research) for the carve-out covering good-faith vulnerability disclosure
  • Send unsolicited or bulk mail through the Service, or use it to facilitate phishing, spoofing, malware distribution, fraud, or other harmful activity
  • Reverse engineer, decompile, or attempt to extract the source of any non-open-source components of the Service, except to the extent permitted by law
  • Resell, sublicense, or commercially exploit the Service or any portion of it without our prior written agreement
  • Use the Service in any manner that would expose us, our users, or third parties to harm

4. Third-party integrations

The Service supports authorising third-party applications to access data on your behalf via OAuth 2.1 / OpenID Connect. When you authorise such an application (a “Relying Party”), that Relying Party operates under its own terms and privacy policy. We are not responsible for the conduct of Relying Parties; you are responsible for choosing which ones to grant access to and for revoking that access when it is no longer needed (you can do so at any time from your account settings).

Conversely, when you sign in to APTcache using a federated identity provider (e.g. Google, GitHub), that provider’s terms govern the authentication step. We receive only the identifiers and claims you authorise the provider to share with us.

5. Your content and data

You retain ownership of any data you submit to the Service (“Customer Data”). You grant APTcache a worldwide, non-exclusive, royalty-free licence to host, store, transmit, display, and process Customer Data solely as necessary to provide the Service to you. We do not use Customer Data for any other purpose, do not sell it, and do not share it except as described in our Privacy Policy.

6. Intellectual property

The Service, including its software, design, and content (excluding Customer Data and any open-source components, which are governed by their respective licences), is the property of APTcache or its licensors and is protected by copyright, trade mark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose, subject to these Terms. No other rights are granted by implication or estoppel.

We welcome feedback. If you submit ideas or suggestions about the Service, you grant us a perpetual, worldwide, royalty-free licence to use them without obligation to you.

7. Service availability and changes

We aim for high availability but do not currently offer a contractual uptime SLA. We may modify, suspend, or discontinue features of the Service at any time. Where a change materially reduces functionality you rely on, we will use commercially reasonable efforts to give advance notice — typically at least 30 days for production-impacting changes, and contemporaneously for security-driven changes that cannot wait.

8. Fees

The Service is currently offered without charge. If we introduce paid plans, we will give you advance notice and the opportunity to accept the new commercial terms or stop using the paid features without penalty. Free-tier usage may be subject to fair-use limits, which we will publish before enforcing them.

9. Termination

You may delete your account at any time from account settings, or by contacting us at support@aptcache.com. Deletion is described in our Privacy Policy.

We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or that doing so is necessary to protect the Service, our users, or third parties. We will give as much notice as is reasonable in the circumstances. On termination, your right to use the Service ends immediately; the provisions that by their nature should survive (including §6, §10–§14) will survive.

10. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. Nothing in this clause limits any warranty or right that cannot be excluded under applicable consumer protection law.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY OR (B) £100. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW (INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR FRAUDULENT MISREPRESENTATION).

12. Indemnification

You agree to indemnify and hold harmless the maintainer of APTcache (and, if APTcache is later incorporated, the resulting entity along with its officers, directors, employees, and agents) from any claim, demand, or expense (including reasonable legal fees) arising out of: (a) your use of the Service in violation of these Terms or applicable law, (b) Customer Data you submit, or (c) infringement by you of any third-party right.

13. Security research

We welcome and encourage good-faith security research. The acceptable-use restrictions in §3 do not apply to research conducted in accordance with our Vulnerability Disclosure Policy, which sets out the scope, rules of engagement, and safe-harbour commitments.

14. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of London, England, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information. Nothing in this clause affects any non-waivable right you have under your local consumer protection law.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email to the address on your account or by a notice on the Service at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance. If you do not agree to the updated Terms, stop using the Service and delete your account before the effective date. Non-material changes (clarifications, contact updates, layout) take effect on publication.

16. General

  • Entire agreement: these Terms together with our Privacy Policy and any additional terms we publish for specific features form the entire agreement between you and APTcache regarding the Service
  • Severability: if any provision is held unenforceable, the remaining provisions will remain in full force
  • No waiver: our failure to enforce any provision is not a waiver of our right to do so later
  • Assignment: you may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets, on notice to you
  • No agency: nothing in these Terms creates a partnership, joint venture, agency, or employment relationship
  • Force majeure: neither party is liable for failure or delay caused by events beyond its reasonable control
